Labour law

One of the key factors on which the success of our Clients’ business is based is the appropriate selection of their team of employees. SSW’s advisory services regarding employment law, broadly understood, seek aim to allow enable our Clients to manage their employees in a manner which is optimal from the perspectives of business and legal security.

Individual labour law

  • Supporting the recruitment processes and selection of employment form
  • Supporting matters related to the employment of managerial personnel (including preparing and issuing opinions on employment and civil law management contracts)
  • Drafting no competition agreements and negotiating the terms thereof
  • Advising on the employment of foreigners in Poland, particularly those occupying managerial positions
  • Advising on any amendments or termination of employment contracts on the basis of the “win-win” rule

Collective employment law

  • Providing comprehensive advisory services concerning the development and implementation of systems, working time schedules and payroll systems
  • Advising on the development and implementation of employee delegation systems and business travel
  • Preparing employers’ regulations and internal policies
  • Providing comprehensive support to employers in their relationships with employees self-governing bodies (trade union organisations, workers’ councils), in particular as regards negotiations and concluding collective agreements
  • Preparing and issuing opinions on corporate employment law acts – work regulations, payroll regulations, bonus payment regulations, regulations of the Company Social Benefits Fund, regulations on using company cars, etc.

Employee disputes

  • Conducting pre-trial analyses of possibilities and risks of employee disputes
  • Representing Clients in employment law disputes before courts of all instances
  • Representing employers before public administration bodies in employment law cases (District Job Centre (PUP), National Labour Inspectorate (PIP), etc.)
  • Advising on how to conduct and resolve collective disputes

Restructuring of workplaces

  • Advising on the optimisation and restructuring of employment
  • Performing comprehensive due diligence with regard to employee matters
  • Planning and transforming organisational structures of workplaces
  • Advising on employee matters related to merger and acquisition processes (divisions, mergers and takeovers of workplaces or organised parts thereof)
  • Implementing voluntary employee redundancy programmes
  • Organising group redundancies (including designing strategies to avoid the use of group redundancy procedures)

Selected projects:

  • Advising on employment law issues surround the creation of the Polish financial centre of a freight forwarding and logistics magnate
  • Preparing and issuing opinions on an agreement with the management personnel within groups of companies
  • Conducting comprehensive employment law due diligence in connection with the largest Poznań retail centre and implementing the recommendations resulting from the audit report
  • Developing a policy for the use of company cars on behalf of one of the largest clothing brands in Europe
