Mariusz Nowakowski

Senior Associate

Mariusz Nowakowski, MLE, advocate, specialises in handling civil and commercial law cases before common courts and arbitration tribunals, specifically those resulting from the performance of complex infrastructure investments (including “FIDIC” contractual models). He also advises in disputes involving a transboundary aspect.

Another area of his activity consists in ongoing legal advice in the course of the implementation of major construction projects in Poland (concerning road and railway projects, as well as buildings construction), including, among other things, claim management. Mariusz also has extensive experience in providing advice in the course of the implementation of other civil law agreements.

In his professional practice he also provides legal assistance in criminal cases (“white collar” crime).

Recent projects:

  • legal advice for a Polish subsidiary of an Austrian group in a series of court and pre-court proceedings concerning the performance of road and railway construction contracts based on FIDIC terms, including the representation of the Client in a precedential dispute over an amendment of an agreement by way of increasing the compensation and adjudication of an additional amount on this account in view of an extraordinary change of prices on the construction market following the execution of the contract
  • contract advice to a Polish company carrying out an investment project (exhibition pavilion) in Italy, and representing the company in a number of court proceedings, including the claim for payment of compensation in respect of the performance of extra works
  • legal advice to a Polish company specialising in the construction of engineering facilities, in the course of arbitration proceedings concerning the performance of a road construction contract in southern Poland, as well as in respect of the performance and settlements under other civil law contracts concluded by the company
  • legal advice to a Polish subsidiary of a German group in the course of court proceedings concerning the largest building construction projects in Poland (including football stadia)
  • legal support of a German manufacturer of premium brand vehicles with respect to the settlements of various types of civil law agreements concluded by the party
  • legal advice in preparatory proceedings and court (criminal) proceedings for a Polish subsidiary of a German group with respect to “white collar” crime cases
